Terms of Service

1. Acceptance of Terms
These Terms of Service (“Terms”) are a contract between you and BabyApps, operated by Dimitrios Kyriakakis, Von-Graffen-Str. 7, 20537 Hamburg, Germany (“BabyApps”, “we”, “our”, or “us”). By downloading, installing, or using the BabyTrack+ app (including its Apple Watch companion app, widgets, and Siri Shortcuts) or visiting babytrack.plus (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 18 years old to create an account. By using the Service you represent that you meet this requirement. If you log care information about a baby or child, you confirm that you are their parent or legal guardian, or are otherwise authorised by a parent or legal guardian to do so.
3. The Service: Free Tier and Plus
You may track one baby on your own free of charge. The free tier works offline and stores your data locally on your device only.
Plus is an optional paid subscription that adds cloud sync, co-parent and caregiver sharing, and support for multiple babies. Plus requires an account and an internet connection to sync.
4. Your Account
- You are responsible for maintaining the security of your credentials.
- You must not share your login with anyone outside of the family-sharing invite system.
- Notify us immediately through our support form if you suspect unauthorized access.
5. Subscriptions, Billing & Cancellation
Plus is offered as an auto-renewing subscription, billed and processed by the Apple App Store or Google Play (as applicable); we use RevenueCat solely to manage subscription entitlements. We do not process or store your payment card details.
- Subscription length, price, and any free trial period are shown at the point of purchase in the App Store or Google Play listing before you buy.
- Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the renewal date.
- You manage and cancel your subscription through your Apple ID or Google account settings — we cannot cancel it on your behalf.
- If you do not cancel before a free trial ends, you will automatically be charged for the subscription.
- Payments are handled entirely by Apple or Google under their own terms; refund requests must be made to Apple or Google directly.
6. EU Right of Withdrawal
If you are a consumer in the European Union, you generally have the right to withdraw from a purchase within 14 days without giving a reason. Because Plus provides digital content and services that begin immediately upon purchase, by subscribing you expressly request immediate access and acknowledge that your right of withdrawal is lost once the subscription has started. You may still cancel future renewals at any time as described in Section 5.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Reverse-engineer, decompile, or disassemble the application
- Attempt to gain unauthorized access to any part of the Service
- Transmit malware, spam, or other harmful content
- Misrepresent your identity or affiliation
8. Intellectual Property
All content, trademarks, and software in the Service are owned by or licensed to BabyApps. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes only.
9. User Content
You retain ownership of the data you enter (baby profiles, tracking entries, etc.). By using the Service you grant us a limited licence to store and process that data solely to provide the Service to you. We do not claim ownership of your content.
10. Family Sharing & Invites
When you invite another person to a board via the invite feature, you acknowledge that they will have access to view and add tracking entries for the baby profiles on that board. You are responsible for who you invite.
If the owner of a shared board deletes their account, invited co-parents and caregivers will lose access to that board's data. Agree with your co-parent in advance on who will remain the account owner.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind. BabyTrack+ is a logbook and companion for personal use — it is not a medical device, and its growth charts and insights are for general information only and do not constitute a medical assessment. Always talk to your pediatrician or another qualified healthcare professional about your baby's growth and health.
12. Limitation of Liability
To the maximum extent permitted by law, BabyApps shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service. Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under German or EU law.
13. Termination
We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time from within the app.
14. Apple App Store Terms
If you downloaded the Service from the Apple App Store, you also agree to Apple's standard Licensed Application End User License Agreement, which governs your use of the app in the event of any conflict with these Terms. Apple has no obligation to provide maintenance or support for the Service, is not responsible for any product liability claims, intellectual property claims, or your compliance with applicable law, and is a third-party beneficiary of these Terms entitled to enforce them against you.
15. Changes to Terms
We may update these Terms periodically. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will notify you of material changes via the app or email.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of protections granted by mandatory consumer-protection laws of your country of habitual residence, and you may bring proceedings in the courts of your place of residence or of Hamburg, Germany.
The European Commission provides an Online Dispute Resolution platform for consumers in the EU. We are not obliged, and do not commit, to participate in dispute-resolution proceedings before a consumer arbitration board.
